Procedural History

On October 2, 2000, the Respondent/mother obtained an Order of Protection in Illinois and on October 6,2002, she initiated divorce proceedings. The Petitioner/father was served with both and promptly petitioned under the Hague Convention.

Summary of Facts

The Petitioner/father and the Respondent/mother married in 1989 and have lived in Italy since before the marriage. The couple's daughter was born in Italy in 1991. The Petitioner/father and the Respondent/mother separated in April 2000, and the Respondent/mother moved into a separate apartment, but the Petitioner/father visited with the child regularly. In September 2000, the Respondent/mother and child left Italy suddenly to care for the Respondent/mother's ailing father in Chicago.
